When you send an e-mail communication, post a comment on this website, or request a tarot reading from The Witch and Smith, you’re also sending personally-identifiable contact information, such as your name, e-mail address, date of birth, credit card information, etc. Please note that as a tarot professional, The Witch and Smith may log, record, track, or save the information you provide through the course of professional record-keeping or other personal, non-commercial use. Your information is never sold to third parties. The Witch and Smith reserves the right to use the information collected from you through your use of this website for any noncommercial, academic, educational, or other not-for-profit uses. The Witch and Smith may from time to time use the information you have provided to contact you about news or updates that The Witch and Smith thinks you may be interested in. Again, by their nature, electronic communications are not always secure. Video Reading Recordings

The Witch and Smith may, at your option, provide video conference tarot readings through third party platforms or hosts, such as Skype or Google Hangout. These video readings may from time to time be recorded. If a video reading is recorded, you will be put on notice in advance of the recording. You are entitled to a copy of the video recording, though charges may apply. Before consenting to a video reading, please go over any questions or concerns you may have with The Witch and Smith. By commencing a video reading, you are consenting to the terms herein. Also, use of the third party platform triggers that third party’s Privacy Policy as well, and you are expected to be familiar with its Privacy Policy and consent thereto. Please be advised that you are not permitted to record video readings without express, written permission from The Witch and Smith. If you would like to record your video tarot reading, please ask before doing so.

General Data Protection Regulation (GDPR)

In accordance with GDPR, you have the right to be informed of how your personal information is used, the right of access to the aforementioned personal information, the right to correct any errors in your personal information, the right to erase your data, the right to restrict processing, and the right to take your personal information elsewhere, if you so choose. The Witch and Smith uses Wix and Google Cloud to gather information; Wix and Google Cloud are both GDPR compliant as of May 2018. If at any time you would like to have your customer information removed, you may send a request to thewitchandsmith@gmail.com and it will be removed. Records Retention

The Witch and Smith does not owe a client any duty to retain the client’s reading records. However, if The Witch and Smith does elect to retain client records, then they must develop and maintain appropriate record-keeping systems for storing their clients’ personal information in a manner that will reasonably preserve the clients’ confidentiality and privacy.

Cookies and Anonymous Identifiers

Through this website, you may receive cookies. Cookies are pieces of information that a website transfers to an individual’s hard drive for record keeping purposes. Cookies are only sent back to the website that deposited them when a visitor returns to that site. Most web browsers are initially set up to accept cookies. You can, however, reset your browser to refuse all cookies or to indicate when a cookie is being sent. Terms of Service

Payment Terms

Full payment must be received by The Witch and Smith before the commencement of your reading. Due to the time and labor required for the longer readings, you must reserve the appointment no less than 48 hours in advance. No appointments may be made 48 hours prior to scheduled appointment.

Payment Methods

For online services and products, The Witch and Smith accepts PayPal. All payment transfers are done through the third party platform(s) The Witch and Smith, PayPal, so please be familiar with the privacy policy and terms of use for these third party platforms. The Witch and Smith is not liable for any mishandling by these third party platforms. For in-person services, cash only. The Witch and Smith does not accept checks or money orders. If your credit card is declined or payment is not properly transferred due to deficiencies on your end, then The Witch and Smith will be entitled to the balance owed plus a 25% interest as additional charge for the deficiency.

Refund Policy

Any online service provided for a fee of $30.00 or less shall be non-refundable. Any online tarot reading service exceeding $30.00 may be refunded if and only if the service provider failed to address your stated inquiry and the refund is authorized by the service provider. To claim a refund, communicate with the tarot professional directly, at which time the service provider at his or her discretion has the opportunity to redo the service, offer a gift certificate for a complimentary future service, or to issue the refund. Refunds without reasonable cause are not permitted. Claims of inaccuracy do not constitute reasonable cause. The client will receive a 15 minute window at the time of the appointment to be present. Once passed the 15 minute time frame the appointment will be considered "missed." Missed appointments are non-refundable.

Disclosure of Limitations

Tarot reading and other divinatory methods are not replacements for licensed, professional care and advice. The Witch and Smith cannot offer legal, medical, financial, or business advice nor does any reading from The Witch and Smith proclaim to. If seeking advice for legal, medical, financial or business-related reasons, please contact those professionals. You should not rely on a tarot reader, or any other form of diviner, for decisions pertaining to your mental, financial, legal, or medical conditions. Readings can only offer guidance on how to cope with situations on a spiritual level.

Fortune Telling Laws

Pursuant to applicable laws of certain jurisdictions, a person can be guilty of fortune telling when, for a fee or compensation, that person claims or pretends to tell fortunes, or holds him/herself out as being able, by claimed or pretended use of occult powers, to answer questions or give advice on personal matters, or to exorcise, influence or affect evil spirits or curses... unless done explicitly for entertainment purposes only. Any and all readings performed by The Witch and Smith neither pretends nor purports to tell the future or use occult powers in contradiction with those laws. In certain jurisdictions, a tarot professional is required to disclose to you that your reading is for entertainment purposes only, and if such a law applies to your reading you are on notice thereof.

Confidentiality of Readings and other Services

The Witch and Smith does its due diligence keeping all information voluntarily given confidential. This includes names, emails, date of birth, payment information, and any other personal identifying data. The Witch and Smith will not sell this information to third parties. The Witch and Smith will not knowingly, willingly, or intentionally disclose your identity or contents of your reading without your prior consent unless The Witch and Smith genuinely believes disclosure is required to 1) prevent harm or threat of harm upon yourself or others, 2) meet any applicable law, regulation, government request, or legal process, 3) to protect The Witch and Smith against claims or threat of claims where The Witch and Smith reserve the right to do so. There is no legal privilege between a tarot reader/client the same way between a doctor/patient, lawyer/client, husband/wife, or priest/penitent.
